CHAPTER 7. PECULIARITIES OF LEGAL STATUS AND ORDER OF ACTIVITIES OF SOME TYPES OF THE CULTURAL INSTITUTIONS
 
Article 38. Theaters, circuses and concert institutions
1. Theater, circus or concert institution is a cultural institution that provides training, organizing, displaying and holding performances, concerts or other public shows for the purpose of aesthetic education of individuals, formation and satisfaction of their needs in theatre (music) arts, popularization of works of theatre (music) arts and artistic creativity of art teams and individual performers.
2. All theaters, circuses and concert halls are open for the public to see performances and other public shows, as well as to listen to works of musical art.
3. Art Council is created and then works in a theatre, circus or a concert institution. The Art Council is a permanent advisory body which provides participation for a team of theater, circus or concert institution in solving creative problems.
Article 39. Club institutions and their work
1. Club institutions are a cultural institution which carries out educative, educational and entertaining functions through the creation of favorable conditions for individuals to engage in traditional and artistic creativity, to satisfy their cognitive and self-educational needs, spiritual and physical development, interpersonal relationships and leisure.
2. State club institutions are available for individuals. The activities of state club institutions are based on the voluntary participation of individuals in the club formations, recognition as their basis of public initiative and amateur performances, on a combination of individual and group work, leadership and self-leadership.
3. Charter of club institutions should include a reference to the rights and responsibilities of individuals who visit a club institution.
4. Types of club institutions, their legal status and the order of work are determined by the Ministry of Culture of the Republic of Belarus.
Article 40. Parks and their work
1. Parks are cultural organizations offering entertaining, educational, aesthetic and eco-educational functions through establishment on their territory special conditions for individuals to relax and entertain, through propagation and popularization of cultural values and knowledge about the nature, formation a careful and humane treatment to the environment.
2. All parks are open for the public.
3. Charter of a park should include a reference to the landowner, the information about the park land, should determine the rights, duties of the park and individuals visiting this park.
4. Park is founded with the consent of the local executive and administrative body.
5. Park must have a master plan approved by the local executive and administrative body.
6. Relations between the park and the local executive and administrative body are regulated by an agreement.
7. When park holds events or activities that may have environmental, social and other consequences affecting the population of the territory, it has to agree these events with the local executive and administrative body.
8. Park coordinates work of institutions of public catering, trade, communal services, landscaping and other institutions located into the park territory.
9. The legal status of parks and their work are determined by the Ministry of Culture of the Republic of Belarus.
Article 41. Scientific research institutions and methodological centers of folk art (cultural and educational work)
1. For the purpose of conducting fundamental and applied scientific research in the field of culture, lending methodological assistance for entities of cultural activities in the Republic of Belarus, scientific research institutions or structural sections of cultural institutions, methodological centers of folk art (cultural and educational work) are established.
2. Legal status, procedure of activities of scientific research institutions in the field of culture are determined by the legislation on scientific activities. Legal status of methodological centers of folk art (cultural and educational work) is determined by the Ministry of Culture of the Republic of Belarus.
Article 42. Libraries and museums, cinematography organizations
Special legal status and procedure of work of libraries, museums, cinematography organizations are determined by the legislation.
