CHAPTER 6. CULTURAL VALUES
Article 35. Kinds of cultural values
1. Depending on the form of implementation of the content, cultural values are divided into:
1.1. material cultural values;
1.2. immaterial cultural values.
2. Depending on the characteristics of the storing (protection) and use, cultural values are divided into:
2.1. historical and cultural values;
2.2. cultural values which make the Library Fund of the Republic of Belarus or are included in the Museum Fund of the Republic of Belarus, with the exception of values which are recognized as historical and cultural values;
2.3. cultural values presented in the established order to give them a status of historical and cultural values;
2.4. other cultural values.
Article 36. Historical and cultural values
The order of giving material objects and immaterial manifestations of human creativity which have a distinctive spiritual, artistic and (or) documentary value, of a status of historical and cultural values, and other issues of historical and cultural values are governed by the legislation on the protection of historical and cultural heritage.
Article 361. Special usage of the cultural values included in the cultural and historical fund of the State Fund of Precious Metals and Precious Stones of the Republic of Belarus
Special usage of the cultural values included in the cultural and historical fund of the State Fund of Precious Metals and Precious Stones of the Republic of Belarus is decided by the legislation in the field of operations of precious metals and precious stones.
Article 37. Import, export and return of cultural values
1. Import and export of cultural values into and out of the Republic of Belarus shall be made under the state control.
2. Procedure of export of historic and cultural values out of the Republic of Belarus is governed by the legislation on the protection of historical and cultural heritage.
3. Export out of the Republic of Belarus for a permanent storage of historical and cultural values which make the Library Fund of the Republic of Belarus or are included in the Museum Fund of the Republic of Belarus (with the exception of values which are recognized historical and cultural ones), as well as submitted to the Ministry of Culture of the Republic of Belarus for consideration of granting them a status of historical and cultural values, is not allowed except cases when such an export is carried out with accordance to an effective international agreements of the Republic of Belarus on the restitution of cultural values by the decision of the Government of the Republic of Belarus adopted in each case of a movement of cultural values or other cases stipulated by legislative acts.
4. Temporary export out of the Republic of Belarus of material cultural values which make the Library Fund of the Republic of Belarus or are included in the Museum Fund of the Republic of Belarus (with the exception of values which are recognized historical and cultural ones, or submitted in accordance with the established order to grant them a status of historical and cultural values), as well as export out of the Republic of Belarus (for a temporary or permanent storage) of other material values (except for the documents which are belonged to the National Archive Fund of the Republic of Belarus), which are cultural values and limited to be transferred through the customs border of the Republic of Belarus when exporting on the ground of non-economic character; the list of such values is approved by the Government of the Republic of Belarus by agreement with the President of the Republic of Belarus, are allowed if there is a permission of the Ministry of Culture of Republic of Belarus.
5. Temporary period of the location of material values outside the Republic of Belarus cannot exceed six months per year.
6. Paragraphs 3–5 of this article shall not apply to the cultural values of other countries, which were temporarily imported at the customs territory of the Republic of Belarus and executed in accordance with the order established by the legislation.
7. Material cultural values exported out of the Republic of Belarus with some infringements of the acts of legislation and international agreements of the Republic of Belarus which were in force at the moment of their export, as well as temporarily exported out of the Republic of Belarus in evacuation, whatever, and having been returned to the Republic of Belarus without legal grounds, are subject to the compulsory return regardless of the time, circumstances and place of export.
