CHAPTER 3. RIGHTS AND RESPONCIBILITIES OF CITIZENS IN THE FIELD OF CULTURE

 

Article 15. Rights and responsibilities of citizens of the Republic of Belarus, foreign citizens and stateless persons in the field of culture

1. Citizens of the Republic of Belarus in the field of culture have a right to:

1.1. decent standard of cultural life;

1.2. receive, store and disseminate complete, accurate and timely information concerning cultural life;

1.3. participate in cultural life;

1.4. freedom of creative activity;

1.5. preservation and development of national cultural traditions;

1.6. intellectual property protection in the field of culture;

1.7. aesthetic upbringing, artistic and culturologica education;

1.8. freedom of associations in the sphere of culture;

1.9. establishment of cultural institutions.

2. Citizens of the Republic of Belarus in the field of culture must:

2.1. preserve historical, cultural and spiritual heritage and other ethnic cultural values;

2.2. respect the culture and language of all national communities living in the Republic of Belarus.

3. Parents or persons who substitute them are obliged to care about aesthetic upbringing, cultural development of children, their adherence to cultural values.

4. Foreign citizens and stateless persons on the territory of the Republic of Belarus enjoy rights and liberties and execute duties in the field of culture equally with the citizens of the Republic of Belarus, unless anything else is stipulated in the Constitution of the Republic of Belarus, this Law and other laws and international agreements of the Republic of Belarus.

Article 16. Right to a decent standard of cultural life

The citizens have a right to be adequately provided with all public services in the field of culture according to their place of residence, also with all the cultural organizations which provide such services, with cultural infrastructure facilities as well as with the quality of disseminated and popularized cultural values and aesthetic living environment.

Article 17. Right to receive, store and disseminate complete, accurate and timely information about cultural life

1. Citizens are guaranteed the right to receive, store and disseminate complete, accurate and timely information about the content of cultural activities, cultural values and facilities of cultural infrastructure.

2. Information about cultural life cannot be provided or disseminated if it constitutes a part of state or other secret data protected by law.

Article 18. Right to participate in cultural life

1. Citizens take part in cultural life by being involved in cultural activities, by having the access (connection) to cultural values and by using them.

2. Everyone’s right to be engaged in cultural activities provides:

2.1. freedom to choose the sphere, type, area and form of cultural activities in accordance with their needs, interests and aptitudes (capabilities);

2.2. possibility to enjoy, independently or in cooperation with other figures of cultural activities, the chosen cultural activity.

3. Everyone’s right to have an access (connection) to cultural values and their use provides:

3.1. freedom of choice of the cultural values that are of interest, and of ways to accede to them;

3.2. possibility to visit cultural institutions and facilities of cultural infrastructure in order to get acquainted with cultural values, to study and acquirement them;

3.3. possibility to accede to cultural values using information recorded on physical media, as well as audio, audiovisual and other messages that are spread by mass media;

3.4. possibility to familiarize themselves with cultural values and to study and acquirement them by the means of direct perception;

3.5. possibility to use cultural property in accordance with the legislation.

4. Right to have a free access (connection) to cultural values is in force when it comes to:

4.1. material cultural values that belong to the state and (or) are in the collections of cultural institutions, which are wholly or partly financed by the means of the national and (or) local budgets;

4.2. immaterial cultural values, exclusive rights to the use of which belong to the state, cultural organizations, fully or partially financed from the national and (or) local budgets, as well as immaterial cultural values that became public property.

5. This Law and other acts of legislation determine the conditions and procedures of getting free access (connection) to cultural values, specified in paragraph 4 of this article.

6. The right to have free access (connection) to cultural values, specified in paragraph 4 of this article, doesn’t exclude the possibility of imposing restrictions that are based on the specific character of cultural values and (or) on the necessity to ensure their preservation.

7. Possibility to have an access (connection) to cultural values which is not mentioned in paragraph 4 of this article, as well as the conditions and procedures of getting such access are determined by the owner or the proprietor of exclusive rights on cultural values, unless anything else is stipulated by legislative acts.

Article 19. Right to preserve and develop national cultural traditions

1. Citizens who belong to any ethnic community and live in the Republic of Belarus have a right to preserve and develop their national culture, to educate children in their national cultural traditions and to use their native language.

2. Citizens who belong to any ethnic community have a right to establish non-government associations that carry out cultural activities in the Republic of Belarus.

Article 20. The right to receive aesthetic upbringing, artistic and culturological education

According to this Law and educational legislation citizens have a right to choose forms and methods of aesthetic upbringing, artistic and culturological education with no age limits.
